Terms and Conditions

Effective Date: April 14th 2025

These Terms and Conditions (“Agreement”) govern the provision of photography services (“Services”) by Newborns By Tess (“Photographer”, “we”, “us”, “our”) to the client (“Client”, “you”, “your”). By booking a session with us, you agree to the following terms:

1. Booking & Payment

A non-refundable yet transferrable deposit fee of $149 is required to secure your session date.
The remaining balance is due by the day of the session.
Sessions are scheduled on a first-come, first-served basis and are only confirmed once the retainer is received.

2. Cancellation & Rescheduling

Cancellations made less than 72 hours before the session may result in a $49 cancellation fee.
One complimentary reschedule is permitted due to illness or emergencies. Additional reschedules may require a new retainer.

3. Session Details

Sessions typically last 1 hour and take place in your home. Going beyond 60 minutes will result in a pro-rated charge of $75 per 15 minutes beyond the allotted time.
Client is responsible for preparing the home (clean space, appropriate temperature, etc.).
Photographer will use natural elements of the home for lifestyle shots.

We can do as many outfit changes as you'd like within the hour. Neutral colors are generally best, but you can choose what you like!

4. Image Delivery & Use

Edited digital images will be delivered within 2-3 weeks via online gallery.
Raw, unedited images will not be provided.

Your purchase will allow for selecting the download of a certain amount of images included in your package. There are plenty of images included; however, purchase of the entire album is always an option.
Client receives personal use rights to all delivered images. Commercial use is not permitted without written permission.

5. Photographer’s Rights

We reserve the right to use images for portfolio, website, social media, and promotional materials.
We retain copyright of all images. But you can use the images for all personal purposes (social media, printing, sharing, etc...)

6. Liability

Photographer is not liable for any injuries sustained during the session or damage to client property.
Photographer takes utmost care in handling equipment and editing, but is not liable for loss or damage due to circumstances beyond control (e.g., file corruption, acts of God).

7. Client Cooperation

Best results may require help if we're including kiddos, pets, or other people. If this is the case, please try to have someone there as a helper to keep things running smoothly.
Disruptions, unsafe behavior, or failure to follow Photographer’s direction may impact image quality.

8. Utah Law

This Agreement is governed by the laws of the State of Utah. Any disputes shall be resolved in the courts of Davis County, Utah.

By paying your retainer and confirming your session, you agree to these Terms and Conditions in full.

Return and Refund Policy

Newborns By Tess - Return and Refund Policy

At Newborns By Tess, we are committed to providing exceptional in-home newborn photography services and ensuring your satisfaction. Please review our return and refund policy below for clarity on our booking and payment terms.

1. Non-Refundable Deposits
A deposit is required to secure your photography session. All deposits are non-refundable due to the reservation of time and resources. However, deposits are transferable to another session date or service within 6 months from the original booking date, subject to availability. To reschedule, please contact us at least 7 days prior to your scheduled session.

2. Cancellations

If you cancel your session more than 7 days before the scheduled date, your deposit may be transferred to a future session within 6 months.
Cancellations within 7 days of the session date will result in a $49 cancellation fee.
In the rare event that Newborns By Tess must cancel a session, we will offer a full refund of any payments made or reschedule at your convenience.

3. Session Fees and Final Payments
Final payments are due on or before the session date. If you are dissatisfied with your session experience, please contact us within 7 days to discuss your concerns. Refunds for final payments are not typically offered but may be considered in exceptional cases at our sole discretion.

4. Photography Products and Digital Images

Digital Images: Once digital images are delivered, they are non-returnable and non-refundable.

5. No-Show Policy
Failure to attend a scheduled session without prior notice will result in forfeiture of the deposit and any payments made. Rescheduling may be possible in extenuating circumstances, subject to our discretion.
